WOOD COUNTY ORDINANCE #223
UNDERAGE ALCOHOL
223.01 DEFINITIONS
Unless specifically
set forth otherwise in a section or subsection, the definition of terms for
purposes of this Chapter shall be the same as those set forth in Chapter 125.02
of the Wisconsin Statutes.
223.02 PROVISIONS OF STATE LAW ADOPTED BY REFERENCE
Pursuant to
125.10(2) Wisconsin Statutes, all provisions of 125.07(4)(a)(b)(bm) are hereby
adopted and by reference made part of this ordinance. This ordinance places
restrictions on any underage person who does the following:
(1)
Procures
or attempts to procure alcohol beverages from a licensee or permitee.
(2)
Possesses
or consumes alcohol beverage on licensed premise.
(3)
Enters,
knowingly attempts to enter, or is on licensed premises in violation of
125.07(3) of Wisconsin Statutes.
(4)
Falsely
represents his/her age for the purpose of receiving alcohol beverages from
licensee or permittee.
(5)
Possesses
or consumes alcohol beverages while not in company of parent, guardian, or
spouse.
Any
further amendments, revisions, modifications, or newly-created provisions of
Wisconsin Statutes, incorporated herein, are intended to be made part of this
Chapter.
223.04 PENALTIES
(1)
For
violations named in 223.2, a person will be subject to a forfeiture of not less
than $50.00 nor more than $1,000, plus court costs.
(2)
In
addition to the monetary penalties, a person violating a section of this
ordinance is subject to license suspension or revocation spelled out in
Wisconsin Statutes 343.30(6).
(3)
In
the event a person fails to pay a forfeiture assessed pursuant to 223.02, the
court may suspend or revoke his/her operating privilege as provided for in
Wisconsin Statutes 345.47 and 48.343(2).
It
is the authority of the Wood County Sheriff’s Department to enforce the
provisions of this Chapter. Sworn law enforcement officers at all levels within
the County shall have authority to issue citations or complaints for violation
of this Chapter.
223.05 REPEAL OF CONFLICTING ORDINANCES
All ordinances
regulating underage alcohol consumption and all ordinances heretofore enacted
by Wood County Board of Supervisors in conflict herewith are hereby repealed.
