DUMPING
230.01 DEFINITIONS
In this Chapter, unless the context requires otherwise, the following shall have the following meanings:
(1) Garbage: Every waste accumulation of animal, fruit, or vegetable matter, liquid or otherwise, resulting from the preparing, processing, storing consuming, cooking, dealing in or with animal, fruit, or vegetable matter.
(2) Yard Waste: Leaves, needles, grass clippings, garden debris, and brush, including clean woody vegetative material, no greater than four (4) inches in diameter. This term does not include stumps, roots, or shrubs with intact root balls.
(3) Refuse: All waste materials
230.02 PROHIBITED CONDUCT
(1) It shall be a violation of this ordinance for any person, firm, or corporation to dispose of, dump or bury garbage, yard waste or refuse, upon any road right-of-way or upon any public or private lands in the unincorporated areas of Wood County other than upon those lands duly designated and licensed as sites for the disposing, dumping, or burying or garbage, yard waste, or refuse.
(2) It shall be a violation of this ordinance for any person, firm or corporation to accept for dumping, burying, or disposing, or allow the dumping, burying, or disposing of garbage or refuse upon land owned by the person, firm, or corporation unless that land is duly designated and licensed as a site for the dumping, disposing, or burying of garbage and refuse.
(3) It shall be a violation of this ordinance to cause or permit garbage, yard waste, or refuse to be placed in such a place or manner that the garbage, yard waste, or refuse can be blown away by the wind,
wasted away by water, or conveyed to another location by some other natural process.
(4) It shall be a violation of this ordinance to cause or permit garbage, yard waste, or refuse to fall from any vehicle onto the road or road right-of-way in the unincorporated areas of Wood County.
230.03 EXCEPTIONS
(1) It shall not be a violation of this ordinance to dump, bury, or dispose of unbagged yard waste on private land if permission has been obtained from the landowner prior to the dumping or disposing of the yard waste.
(2) It shall not be a violation of this ordinance for a landowner to dump, bury, or dispose of garbage, yard waste, or refuse on the landowners own land, unless said garbage, yard waste, or refuse is defined as hazardous under 144.62 (2)(b) Wisconsin Statutes.
230.04 PENALTY
Any person who violates this ordinance shall upon conviction thereof forfeit not less than fifty dollars ($50.00) nor more than two hundred dollars ($200.00) plus the cost of prosecution as provided by 814.63(4) Wisconsin Statutes and the jail assessment imposed by 302.46(1) Wisconsin Statutes.
230.05 ENFORCEMENT
Sworn Wood County Sheriffs Department Deputies within the unincorporated areas of Wood County shall have the authority to enforce this Chapter and shall have authority to issue citations or complaints for violations of this Chapter.
230.06 REPEAL OF CONFLICTING ORDINANCES
All ordinances or parts of ordinances and resolutions in conflict herewith are hereby repealed. This ordinance shall take effect upon passage and publication.
230.07 SEVERABILITY
If any section clause, or division of this ordinance be declared by the court to be invalid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid.
